2. Scope, Definitions
2.1 The following General Terms and Conditions (GTC) apply to all contracts concluded between a consumer or an entrepreneur and us via the product offers presented in the online shop.
2.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business is any natural or legal person or partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.
3. Contract language and contract conclusion
3.1 Contracts in our online shop are concluded exclusively in German.
3.2 Our product offers in the online shop are non-binding. By clicking the "Order with obligation to pay" button at the end of the ordering process, you submit a binding contractual declaration to conclude a purchase agreement for the products in your shopping cart. You are bound to your contractual offer for a maximum of three days.
3.3 A contract is concluded when we accept your offer within the binding period by sending an order confirmation.
3.4 For deliveries to Switzerland, the purchase agreement is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). MeinEinkauf AG also handles customs clearance, invoicing, and delivery within Switzerland. This service is included in the purchase price and any applicable shipping costs. To ensure smooth delivery, MeinEinkauf GmbH in Konstanz, Germany (DE285677365) is integrated into the supply chain. This does not incur any additional costs for the buyer.
4. Prices, shipping costs
4.1 All prices listed in the online shop are total prices. The total prices include all price components, including the applicable value added tax.
4.2 We charge separately for packaging and shipping (shipping costs) if the products are not marked as shipping-free. The amount of the shipping costs varies depending on the product brand. Currently, the shipping costs are €4.90 for standard shipments to Germany and Austria. Please refer to the respective product pages for any differing regulations for each product brand.
5. Payment terms
Please refer to the footer for the payment methods we offer.
6. Delivery restrictions and delivery date
6.1 We deliver to Germany and Austria. If PayPal is selected as the payment method, delivery is only possible to the delivery address registered in the PayPal account.
6.2 The delivery time is usually 1-5 days after the order date. We expressly point out that delivery may take longer than 1-5 days.
6.3 The goods will be shipped directly from one of our fulfillment partners.
7. Retention of title
The goods remain our property until full payment is received.
8. Statutory Right of Withdrawal
The statutory right of withdrawal applies exclusively to consumers within the EU member states. Section 2.2 of these terms and conditions defines a consumer.
9. Statutory liability for defects
You are entitled to statutory warranty rights for products purchased from us. Please feel free to contact us if you have any questions.
10. Applicable law, place of jurisdiction
10.1 The law of the Federal Republic of Germany shall apply to the conclusion and execution of all contracts, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not restrict the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.
10.2 In business transactions with merchants and legal entities under public law, our registered office is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same applies if a businessperson does not have a general place of jurisdiction in Germany or if their domicile and/or habitual residence is unknown at the time the action is brought. Our right to bring an action before a court at another legally established place of jurisdiction remains unaffected.
B. Customer information
1. Individual technical steps leading to the conclusion of the contract.
The ordering process in our online shop is carried out via labeled and self-explanatory buttons that are activated with a mouse click. To submit a binding contractual declaration, you must complete the following technical steps:
- Adding the item to the shopping cart
- Log in to the online shop with an existing customer account (username/password) or register as a new customer and enter your personal data
- Payment method selection
- Confirmation of the terms and conditions, cancellation policy
- Summary of all order data
- Submission of your contractual declaration, which contains your contractual offer.
The acceptance of your contractual declaration is governed by section 3 of our terms and conditions (see above under A.).
2. Storage and retrieval of the contract text after conclusion of the contract
The contract text is stored by us.
3. Detection and correction of input errors in the ordering process
You can identify input errors at any time during the ordering process because your entries are saved immediately and displayed on the screen. If you make a mistake, please use the labeled and self-explanatory buttons that we provide during the ordering process to correct it. On the final order page, you can review and correct all order details again before submitting your order.
